We’ve just received news that on the 5th of August there was an update to our lastest labour agreement (the IXth), and I wanted to share it with you all.

Summary of the main changes.
The update was made to reflect two things:
- How the recent rises in the SMI (minimum professional wage) affect teacher’s rates. Even though many are not using the convenio rates (unfortunately), for those who are, please take a look at the rise in the category of «Profesor Auxiliar». I know many have that category and the salary has gone up. It should be reflected in your pay roll.
- And update in the types of contracts. Mainly to reflect the changes in the new law refering to fijos discontínuos, temporales, obra y servicio, de formación etc. All these are valid but under specific conditions «Los trabajadores afectados por el presente Convenio podrán ser contratados a tenor de cualquiera de las modalidades legales establecidas en cada momento«.
There are also some interesting points reflecting how long can a worker be under temporary contracts :
«Asimismo, adquirirá la condición de fija la persona que ocupe un puesto de trabajo que haya estado ocupado con o sin solución de continuidad, durante más de dieciocho meses en un periodo de veinticuatro meses mediante contratos por circunstancias de la producción, incluidos los contratos de puesta a disposición realizados con empresas de trabajo temporal.»
Los trabajadores contratados por la empresa sin pactar modalidad especial alguna en cuanto a su duración, se considerarán fijos, transcurrido el período de prueba, salvo prueba en contrario que acredite la naturaleza temporal del mismo.
También adquirirán la condición de personas trabajadoras fijas, las personas trabajadoras que en un periodo de veinticuatro meses hubieran estado contratadas durante un plazo superior a dieciocho meses, con o sin solución de continuidad, para el mismo o diferente puesto de trabajo con la misma empresa o grupo de empresas, mediante dos o más contratos por circunstancias de la producción, sea directamente o a través de su puesta a disposición por empresas de trabajo temporal.»
This was always so, but it’s nice to have it reflected in our convenio. Basically, if you’ve been working for a while (read above for the number of months) for a company, you are under a permanent contract, independently of what your contract says.
Some needed changes and it’s nice to see the convenio is being updated more frequently now.
My academy claims the latest BOE means all workers who have a fijo indefinido must change to a fijo discontinuo. Supposedly, inspección de trabajo back this up.
Our contract have been changed automatically as we have been told the previous contracts are now not legal.
